1. Acceptance of Terms
By accessing or using the BeautySoft software ("the Service"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use the Service.
2. Service Description
BeautySoft is cloud-based management software designed for beauty salons and spas. The Service includes, depending on the plan, appointment management, inventory, invoicing, payroll, and reporting.
3. User Accounts
You are responsible for maintaining the confidentiality of your account and password. You must notify us immediately of any unauthorized use of your account. You may not use another person's account without their express permission.
4. Acceptable Use
You agree not to:
- Use the Service for illegal or unauthorized purposes
- Attempt to access data of other users or businesses
- Interfere with the operation of the Service
- Reproduce, duplicate, or resell the Service without authorization
- Upload malicious content or content that infringes third-party rights
5. Billing and Payments
Subscription plans are billed monthly. Prices are subject to change with 30 days' notice. Failure to pay may result in suspension of the Service. No refunds are issued for partial usage periods.
6. Data Ownership
You retain all rights to the data you upload to the Service. BeautySoft will not claim ownership of your data. We reserve the right to use aggregated, anonymized data to improve the Service.
7. Service Availability
We strive to maintain 99.9% availability but do not guarantee that the Service will be free from interruptions. Scheduled maintenance will be performed outside business hours when possible, with advance notice.
8. Cancellation
You may cancel your subscription at any time. Upon cancellation, you will have access to the Service through the end of your current billing period. Your data will remain available for 30 days after cancellation for export.
9. Limitation of Liability
BeautySoft will not be liable for indirect, incidental, or consequential damages arising from the use or inability to use the Service. Our maximum liability is limited to the amount paid by you in the last 12 months.
10. Modifications
We reserve the right to modify these terms at any time. We will notify you of significant changes via email or a notice in the Service. Continued use of the Service after notification constitutes acceptance of the modified terms.
11. Governing Law
These terms are governed by and interpreted in accordance with the laws of the Dominican Republic. Any disputes will be resolved in the competent courts of the Distrito Nacional.
